Assumption of Risk, Waiver, Liability Release, and Hold Harmless Agreement

IMPORTANT – READ CAREFULLY – THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS

Surface Supplied Air diving with NEMO and BLU3 products is a fun and exciting way to explore the shallow depths of the underwater world. As with any underwater adventure that relies on air delivery equipment there are inherent risks that may result in serious illness, injury or death. Each NEMO diver assumes these inherent risks regardless of experience, age or environment just as swimmers and scuba divers assume these risks in supervised and unsupervised settings, at pools, open water, around watercraft and other water hazards. In consideration of using BLU3 dive gear the OWNERS/USERS expressly agree to the terms and conditions of this Assumption of Risk Liability Release, Wavier and Hold Harmless Agreement, (herein referred to as AGREEMENT).

“OWNERS/USERS” shall refer collectively to the following: each individual owner of a NEMO and BLU3 products, each individual user of a NEMO or BLU3 products, any person who suffers loss in the form of property damage, illness, injury, or death, including but not limited to family, heirs, assigns, entities or anyone who may have a claim, cause of action, legal right or other remedy as a consequence of property damage, illness, injury or death as a result of using BLU3 products.

“RELEASED PARTIES” shall refer collectively to the following: BLU3, Inc., Brownies Marine Group, Inc., including but not limited to their respective manufacturers, assemblers, distributors, retailers, service centers, owners, employees, representatives, agents, independent contractors, affiliates, consultants, investors, insurers, assigns, successors, and any other person or entity that may be liable to OWNERS/USERS for property damage, illness, injury or death as a result of a BLU3 product.

VOLUNTARY PARTICIPATION & INFORMED CONSENT: OWNERS/USERS voluntarily and with informed consent participate in activities using NEMO and BLU3 products with the understanding there are inherent risks of property damage, illness, injury and death associated with their use.

OWNERS/USERS EXCLUSIVELY BEAR THE FOLLOWING RESPONSIBILITIES:

• • OWNERS/USERS are responsible for the safety of each person using NEMO and BLU3 products.
  • OWNERS/USERS are responsible for reading and complying with the most recent edition of the Owner’s - Users Manual found at diveblu3.com/owners-users-manual
  • OWNERS/USERS are responsible to verify all persons using NEMO and BLU3 products have completed the NEMO Online Dive Training Course.
  • OWNERS/USERS are responsible for appropriately supervising each NEMO diver while they are in the water.
  • OWNERS/USERS are responsible for each NEMO diver being medically, mentally and physically fit to dive using NEMO. See the NEMO Fitness to Dive Evaluation at diveblu3.com/fitness-to-dive-evaluation
  • OWNERS/USERS are responsible for at least one adult diver in the water to supervise and be responsible for each youth (under 18 years old) diving with NEMO or BLU3 products.
  • OWNERS/USERS are responsible for properly checking each NEMO diver’s buoyancy in accordance with instructions found at diveblu3.teachable.com
  • OWNERS/USERS are responsible to ensure each NEMO diver is property trained in and uses appropriate ascent procedures to avoid lung overexpansion injuries in accordance with instructions found at diveblu3.teachable.com
  • OWNERS/USERS are responsible to ensure each NEMO diver only uses the NEMO and BLU3 equipment as designed and expressly intended.
  • OWNERS/USERS shall be exclusively responsible and liable for any injuries and damages caused by NEMO and BLU3 products.

ASSUMPTION OF RISK: Each OWNER/USER of NEMO and BLU3 products expressly assumes full and complete risk of property damage, illness, injury and death as a result of use of RELEASED PARTIES equipment, failure to warn, inadequate instructions and/or product liability due to maintenance failure, defect or implied warranty. OWNERS/USERS expressed assumption of risk extend to each and every diver, person and/or entity that may suffer loss due to property damage, illness, injury or death associated with use of any RELEASED PARTIES products.

WAIVER & RELEASE OF LIABILITY: OWNERS/USERS expressly WAIVE and RELEASE the RELEASED PARTIES all liability and responsibility whatsoever resulting in property damage, illness, injury or death caused by negligence including gross negligence by the RELEASED PARTIES, whether the negligent act(s) were passive or active, direct or indirect, to the fullest extent allowed by law, even if WAIVING and RELEASING the RELEASED PARTIES is socially unacceptable or generally against public expectations. By signing this AGREEMENT the OWNERS/USERS expressly, completely and unconditionally agree not to sue the RELEASED PARTIES for negligence resulting in property damage, illness, injury or death.

HOLD HARMLESS & INDEMNIFICATION: OWNERS/USERS agree to HOLD HARMLESS and INDEMNIFY the RELEASED PARTIES from all claims, causes of action or lawsuits, arising from use of BLU3 products, including but not limited to the NEMO surface supplied air diving systems. This AGREEMENT obligates OWNERS/USERS to pay all costs to investigate, defend, pay judgments, court costs, attorneys’ fees, etcetera incurred by RELEASED PARTIES to enforce this AGREEMENT.

LEGAL CONTRACT, GOVERNING LAW & SEVERABILITY: OWNERS/USERS understand this AGREEMENT is a contract giving up legal rights. This AGREEMENT shall be in full legal force from the date signed into the future until all claims and legal action against the RELEASED PARTIES have been fully resolved. All legal actions arising as a result of this AGREEMENT shall be governed by the Laws of the State of Florida and the exclusive venue and jurisdiction of any legal action shall be Broward County, Florida. If any portion of this AGREEMENT is found to be unenforceable or invalid, then that portion shall be severed and the remainder shall continue in full legal force. Any digital completion, signature, confirmation or electronic format of this AGREEMENT shall have full legal force as if it was an original signed document. The OWNERS/USERS voluntarily enter into this AGREEMENT based exclusively on the preprinted terms of the AGREEMENT without modification or relying on any other representations or assurances.

OWNERS/USERS have fully read, understand and agree to be legally bound by this AGREEMENT. By signing this AGREEMENT, OWNERS/USERS are giving up legal rights for myself and all others who may have a claim, on my or their behalf, against the RELEASED PARTIES as a result of property damage, illness, injury or death caused by NEMO and BLU3 products.

In considerazione dell'utilizzo di BLU3 attrezzatura subacquea i proprietari/utenti espressamente accettare i termini e le condizioni del presente Assunzione di responsabilità liberatoria del rischio, rinuncia e tenere indenne accordo, (qui di seguito denominato ACCORDO).

"PROPRIETARI/UTENTI" si riferisce collettivamente a quanto segue: ogni singolo proprietario di un NEMO e BLU3 prodotti, ogni singolo utente di un NEMO o BLU3 prodotti, qualsiasi persona che subisce una perdita sotto forma di danni alla proprietà, malattia, lesioni o morte, compreso ma non limitato alla famiglia, eredi, cessionari, entità o chiunque possa avere un reclamo, causa di azione, diritto legale o altro rimedio come conseguenza di danni alla proprietà, malattia, lesioni o morte a seguito di utilizzo di prodotti BLU3.

"PARTI RILASCIATE" si riferisce collettivamente a quanto segue: BLU3, Inc., Brownie’s Marine Group, Inc., compresi ma non limitati ai rispettivi produttori, assemblatori, distributori, rivenditori, centri di servizio, proprietari, dipendenti, rappresentanti, agenti, appaltatori indipendenti, affiliati, consulenti, investitori, assicuratori, assegnatari, successori, e qualsiasi altra persona o entità che può essere responsabile nei confronti dei proprietari/utenti per danni alla proprietà, malattia, lesioni o morte come conseguenza di un prodotto BLU3.

PARTECIPAZIONE VOLONTARIA E CONSENSO INFORMATO: I proprietari/utenti partecipano volontariamente e con il consenso informato alle attività che utilizzano i prodotti NEMO e BLU3 con la consapevolezza che ci sono rischi intrinseci di danni alla proprietà, malattia, lesioni e morte associati al loro utilizzo.I

PROPRIETARI/UTENTI SI ASSUMONO ESCLUSIVAMENTE LE SEGUENTI RESPONSABILITÀ:        

• I PROPRIETARI/UTENTI sono responsabili della sicurezza di ogni persona che utilizza i prodotti NEMO e BLU3.

• I PROPRIETARI/UTILIZZATORI sono responsabili della lettura e del rispetto dell'edizione più recente del Manuale del proprietario/utente che si trova su diveblu3.com/owners-users-manual

• I PROPRIETARI/UTILIZZATORI sono responsabili di verificare che tutte le persone che utilizzano i prodotti NEMO e BLU3 abbiano completato il corso di formazione NEMO Online Dive Training.

• I PROPRIETARI/UTENTI hanno la responsabilità di supervisionare adeguatamente ogni subacqueo NEMO mentre è in acqua.

• I PROPRIETARI/UTENTI sono responsabili della presenza in acqua di almeno un subacqueo adulto che sorveglia e sia responsabile di ogni giovane (sotto i 18 anni) che si immerge con i prodotti NEMO o BLU3.

• I PROPRIETARI/UTILIZZATORI sono responsabili di controllare correttamente l'assetto di ogni subacqueo NEMO in conformità con le istruzioni trovate su diveblu3.teachable.com

• I PROPRIETARI/UTILIZZATORI sono responsabili di garantire che ogni subacqueo NEMO sia addestrato alla proprietà e utilizzi procedure di risalita appropriate per evitare lesioni da sovraespansione polmonare in conformità con le istruzioni trovate su diveblu3.teachable.com

• I PROPRIETARI/UTILIZZATORI sono responsabili di garantire che ogni subacqueo NEMO utilizzi solo l'attrezzatura NEMO e BLU3 come progettato ed espressamente previsto.

• I proprietari/utilizzatori sono esclusivamente responsabili di eventuali lesioni e danni causati dai prodotti

NEMO e BLU3.ASSUNZIONE DEL RISCHIO: Ogni PROPRIETARIO/UTENTE dei prodotti NEMO e BLU3 si assume espressamente il rischio pieno e completo di danni alla proprietà, malattia, lesioni e morte come risultato dell'uso delle apparecchiature delle PARTI RILASCIATE, mancato avvertimento, istruzioni inadeguate e/o responsabilità del prodotto a causa di guasti di manutenzione, difetto o garanzia implicita. L'espressa assunzione di rischio da parte dei proprietari/utilizzatori si estende a tutti i subacquei, persone e/o entità che possono subire perdite dovute a danni alla proprietà, malattie, lesioni o morte associate all'uso di qualsiasi prodotto di

PARTI RILASCIATE.RINUNCIA E SCARICO DI RESPONSABILITÀ: I PROPRIETARI/UTILIZZATORI rinunciano e sollevano espressamente le PARTI RILASCIATE da qualsiasi responsabilità derivante da danni alla proprietà, malattia, lesioni o morte causati da negligenza, compresa la negligenza grave delle PARTI RILASCIATE, sia che l'atto o gli atti di negligenza siano stati passivi o attivi, diretti o indiretti, nella misura massima consentita dalla legge, anche se la rinuncia e il rilascio delle PARTI RILASCIATE è socialmente inaccettabile o generalmente contrario alle aspettative pubbliche. Firmando il presente ACCORDO i PROPRIETARI/UTENTI accettano espressamente, completamente e incondizionatamente di non citare in giudizio le PARTI RILASCIATE per negligenza risultante in danni alla proprietà, malattia, lesioni o morte.

MANLEVA E INDENNIZZO: I PROPRIETARI/UTENTI accettano di MANLEVARE e INDENNIZZARE le PARTI RILASCIATE da tutti i reclami, cause di azione o cause legali, derivanti dall'uso dei prodotti BLU3, compresi, ma non solo, i sistemi di immersione ad aria compressa NEMO. Il presente ACCORDO obbliga i PROPRIETARI/UTENTI a pagare tutte le spese di indagine, difesa, pagamento di sentenze, spese processuali, spese legali, eccetera sostenute dalle PARTI RILASCIATE per far rispettare il presente

ACCORDO.CONTRATTO LEGALE, LEGGE REGOLATRICE E SEVERABILITÀ: i proprietari/utenti sono consapevoli che il presente ACCORDO è un contratto che rinuncia a diritti legali. Il presente ACCORDO avrà pieno valore legale dalla data della firma fino al futuro, fino a quando tutti i reclami e le azioni legali contro le PARTI RILASCIATE saranno stati completamente risolti. Tutte le azioni legali derivanti dal presente ACCORDO saranno disciplinate dalle leggi dello Stato della Florida e la sede e la giurisdizione esclusiva di qualsiasi azione legale sarà la Contea di Broward, Florida. Se una qualsiasi parte di questo ACCORDO è ritenuta inapplicabile o non valida, allora tale parte sarà separata e il resto continuerà ad avere pieno valore legale. Qualsiasi completamento digitale, firma, conferma o formato elettronico di questo ACCORDO avrà pieno valore legale come se fosse un documento originale firmato. I

PROPRIETARI/UTILIZZATORI stipulano volontariamente il presente ACCORDO basandosi esclusivamente sui termini prestampati dell'ACCORDO senza modificare o fare affidamento su altre dichiarazioni o garanzie.I PROPRIETARI/UTILIZZATORI hanno letto, compreso e accettato di essere legalmente vincolati dal presente ACCORDO. Firmando il presente ACCORDO, i PROPRIETARI/UTENTI rinunciano ai diritti legali per me e per tutti gli altri che potrebbero avere un reclamo, per mio o loro conto, contro le PARTI RILASCIATE in seguito a danni materiali, malattie, lesioni o morte causati dai prodotti NEMO e BLU3.

Vereinbarung über Risikoübernahme, Verzicht, Haftungsfreistellung und Haftungsfreistellung

WICHTIG - LESEN SIE SORGFÄLTIG - DIESE VEREINBARUNG BETRIFFT IHRE GESETZLICHEN RECHTE

Das Tauchen mit oberflächen gespeister Luft mit NEMO- und BLU3-Produkten ist eine lustige und aufregende Art, die flachen Tiefen der Unterwasserwelt zu erkunden. Wie bei jedem Unterwasserabenteuer, das sich auf Luftversorgung Geräte stützt, gibt es inhärente Risiken, die zu ernsthafter Krankheit, Verletzung oder Tod führen können. Jeder NEMO-Taucher übernimmt diese inhärenten Risiken unabhängig von seiner Erfahrung, seinem Alter oder seiner Umgebung, genauso wie Schwimmer und Gerätetaucher diese Risiken in beaufsichtigten und unbeaufsichtigten Umgebungen, in Schwimmbädern, im Freiwasser, in der Nähe von Wasserfahrzeugen und anderen Wassergefahren übernehmen. In Anbetracht der Nutzung der BLU3-Tauchausrüstung erklären sich die EIGENBESITZER/BENUTZER ausdrücklich mit den Bedingungen dieser Vereinbarung zur Risikoübernahme, Haftungsfreistellung, Verzichtserklärung und Haftungsfreistellung (im Folgenden als VEREINBARUNG bezeichnet) einverstanden.

"EIGENTÜMER/BENUTZER" bezieht sich kollektiv auf Folgendes: jeden einzelnen Besitzer eines NEMO- und BLU3-Produkts, jeden einzelnen Benutzer eines NEMO- oder BLU3-Produkts, jede Person, die einen Schaden in Form von Sachschäden, Krankheit, Verletzung oder Tod erleidet, einschließlich, aber nicht beschränkt auf Familienangehörige, Erben, Rechtsnachfolger, juristische Personen oder jede Person, die einen Anspruch, einen Klagegrund, ein gesetzliches Recht oder einen anderen Rechtsbehelf als Folge von Sachschäden, Krankheit, Verletzung oder Tod als Folge der Verwendung von BLU3-Produkten haben könnte.

"BEFREITE PARTEIEN" bezieht sich kollektiv auf die folgenden: BLU3, Inc. und Brownies Marine Group, Inc. einschließlich, aber nicht beschränkt auf ihre jeweiligen Hersteller, Monteure, Händler, Einzelhändler, Servicecenter, Eigentümer, Angestellte, Vertreter, Agenten, unabhängige Auftragnehmer, verbundene Unternehmen, Berater, Investoren, Versicherer, Abtretungsempfänger, Rechtsnachfolger und jede andere natürliche oder juristische Person, die gegenüber EIGENTÜMERN/BENUTZERN für Sachschäden, Krankheiten, Verletzungen oder Tod als Folge eines BLU3-Produkts haftbar sein kann.

FREIWILLIGE TEILNAHME & INFORMIERTE ZUSTIMMUNG: EIGENTÜMER/BENUTZER nehmen freiwillig und mit informierter Zustimmung an Aktivitäten teil, bei denen NEMO- und BLU3-Produkte verwendet werden, wobei sie sich darüber im Klaren sind, dass mit der Verwendung dieser Produkte das Risiko von Sachschäden, Krankheiten, Verletzungen und Tod verbunden ist.

EIGENTÜMER/BENUTZER TRAGEN AUSSCHLIEßLICH DIE FOLGENDEN VERANTWORTLICHKEITEN:

EIGENTÜMER/BENUTZER sind für die Sicherheit jeder Person, die NEMO- und BLU3-Produkte benutzt, verantwortlich.

Die EIGENTÜMER/NUTZER sind dafür verantwortlich, die neueste Ausgabe des Benutzerhandbuchs unter diveblu3.com/owners-users-manual zu lesen und zu befolgen.

EIGENTÜMER/NUTZER sind dafür verantwortlich, dass alle Personen, die NEMO- und BLU3-Produkte benutzen, den NEMO Online-Tauchkurs absolviert haben.

EIGENTÜMER/NUTZER sind dafür verantwortlich, jeden NEMO-Taucher angemessen zu beaufsichtigen, während er sich im Wasser befindet.

EIGENTÜMER/NUTZER sind dafür verantwortlich, dass jeder NEMO-Taucher medizinisch, geistig und körperlich fit für das Tauchen mit NEMO ist. Siehe die NEMO Tauchtauglichkeit Bewertung unter diveblu3.com/fitness-to-dive-evaluation

EIGENTÜMER/NUTZER sind dafür verantwortlich, dass sich mindestens ein erwachsener Taucher im Wasser befindet, der jeden Jugendlichen (unter 18 Jahren), der mit NEMO- oder BLU3-Produkten taucht, beaufsichtigt und für ihn verantwortlich ist.

EIGENTÜMER/NUTZER sind dafür verantwortlich, die Tarierung jedes NEMO-Tauchers gemäß den Anweisungen unter diveblu3.teachable.com ordnungsgemäß zu überprüfen.

Der EIGENTÜMER/BENUTZER ist dafür verantwortlich, sicherzustellen, dass jeder NEMO-Taucher in den entsprechenden Aufstiegsverfahren geschult ist und diese anwendet, um Verletzungen durch Lungenüberdehnung gemäß den Anweisungen auf diveblu3.teachable.com zu vermeiden.

Die EIGENTÜMER/NUTZER sind dafür verantwortlich, dass jeder NEMO-Taucher die NEMO- und BLU3-Ausrüstung nur so verwendet, wie sie konstruiert und ausdrücklich vorgesehen ist.

EIGENTÜMER/BENUTZER sind ausschließlich verantwortlich und haftbar für alle Verletzungen und Schäden, die durch NEMO- und BLU3-Produkte verursacht werden.

ÜBERNAHME DES RISIKOS: Jeder EIGENTÜMER/BENUTZER von NEMO- und BLU3-Produkten übernimmt ausdrücklich das volle und vollständige Risiko von Sachschäden, Krankheiten, Verletzungen und Tod als Folge der Verwendung von Geräten der FREIGESTELLTEN PARTEIEN, unterlassener Warnung, unzureichender Anweisungen und/oder Produkthaftung aufgrund von EIGENTÜMER/BENUTZER, Defekten oder stillschweigender Garantie. Die ausdrückliche Risikoübernahme durch den EIGENTÜMER/NUTZER erstreckt sich auf jeden Taucher, jede natürliche und/oder juristische Person, die einen Verlust aufgrund von Sachschäden, Krankheit, Verletzung oder Tod in Verbindung mit der Nutzung von Produkten der RELEASED PARTIES erleiden kann.

VERZICHT & HAFTUNGSFREISTELLUNG: EIGENTÜMER/NUTZER VERZICHTEN ausdrücklich auf jegliche Haftung und Verantwortung, die sich aus Sachschäden, Krankheit, Verletzung oder Tod ergeben, die durch Fahrlässigkeit, einschließlich grober Fahrlässigkeit der FREIZEIT PARTEIEN verursacht wurden, unabhängig davon, ob die fahrlässige(n) Handlung(en) passiv oder aktiv, direkt oder indirekt war(en), und zwar im vollen gesetzlich zulässigen Umfang, selbst wenn der VERZICHT auf die FREIZEIT PARTEIEN gesellschaftlich inakzeptabel ist oder allgemein gegen die öffentlichen Erwartungen verstößt. Mit der Unterzeichnung dieser VEREINBARUNG erklären sich die EIGENTÜMER/NUTZER ausdrücklich, vollständig und bedingungslos damit einverstanden, die ENTLASTETEN PARTEIEN nicht wegen Fahrlässigkeit zu verklagen, die zu Sachschäden, Krankheit, Verletzung oder Tod führt.

HAFTUNGSFREISTELLUNG & SCHADENSERSATZ: Die EIGENBESITZER/NUTZER verpflichten sich, die BEFREIEN PARTEIEN von allen Ansprüchen, Klagen oder Gerichtsverfahren freizustellen, die sich aus der Nutzung von BLU3-Produkten ergeben, einschließlich, aber nicht beschränkt auf die oberfläche versorgten NEMO-Luft Tauchsysteme. Diese VEREINBARUNG verpflichtet die EIGENEN/BENUTZER, alle Kosten für die Untersuchung, Verteidigung, Zahlung von Urteilen, Gerichtskosten, Anwaltsgebühren usw. zu tragen, die den BEFREIEN PARTEIEN zur Durchsetzung dieser VEREINBARUNG entstehen.

RECHTSVERTRAG, RECHTSANWENDUNG & WIDERRUF FÄHIGKEIT: Die EIGENTÜMER/NUTZER verstehen, dass diese VEREINBARUNG ein Vertrag ist, mit dem sie ihre Rechte aufgeben. Diese VEREINBARUNG gilt ab dem Datum der Unterzeichnung bis in die Zukunft, bis alle Ansprüche und rechtlichen Schritte gegen die VERTRAGSPARTEIEN vollständig geklärt sind. Alle Rechtsstreitigkeiten, die sich aus dieser VEREINBARUNG ergeben, unterliegen den Gesetzen des Staates Florida und der ausschließliche Gerichtsstand und die Gerichtsbarkeit für alle Rechtsstreitigkeiten ist Broward County, Florida. Sollte sich ein Teil dieser VEREINBARUNG als nicht durchsetzbar oder ungültig erweisen, so wird dieser Teil abgetrennt und der Rest bleibt in vollem Umfang rechtsgültig. Jede digitale Vervollständigung, Unterschrift, Bestätigung oder jedes elektronische Format dieser VEREINBARUNG hat volle Rechtskraft, als ob es sich um ein unterzeichnetes Original Dokument handelt. Die EIGENTÜMER/NUTZER schließen diese VEREINBARUNG freiwillig und ausschließlich auf der Grundlage der vorgedruckten Bedingungen der VEREINBARUNG ab, ohne sie zu ändern oder sich auf andere Zusicherungen oder Zusagen zu verlassen.

Die EIGENTÜMER/NUTZER haben diese VEREINBARUNG vollständig gelesen, verstanden und erklären sich damit einverstanden, rechtlich an diese VEREINBARUNG gebunden zu sein. Mit der Unterzeichnung dieser VEREINBARUNG verzichten die EIGENTÜMER/NUTZER für sich selbst und alle anderen, die in meinem oder ihrem Namen einen Anspruch gegen die BEFREITEN PARTEIEN aufgrund von Sachschäden, Krankheiten, Verletzungen oder Tod durch NEMO- und BLU3-Produkte haben könnten, auf ihre gesetzlichen Rechte.
